PANG-AABUSO AT KORAPSIYON SA BADYET NG PAMAHALAAN, BABANTAYAN NG KAMARA

Magbabantay ang Kamara de Representantes laban sa pang-aabuso at korapsyon.


Ito ang babala ni House Speaker Martin Romualdez sa sinumang mayroong pansariling interes sa panukalang pambansang budget sa susunod na taon.


Sa kanyang opening address bago ang pagtalakay sa 2025 General Appropriations Bill sa plenaryo, pinatamaan ni Romualdez ang ilang kritiko na minamaliit ang tungkulin ng Kamara at iginigiit ang accountability o pananagutan ngunit sablay naman ang paggastos ng pondo.


Hindi aniya kukunsintihin ng Kongreso ang pagiging ipokrito at hindi ipagwawalang-bahala ang tiwala ng publiko.


Binigyang-diin din ni Romualdez na hindi maaaring magturo ang mga may sariling kasalanan at sa harap ng Kongreso ay dadaan ang lahat sa tamang proseso at walang makakatakas sa pananagutan.


Prayoridad umano ng Mababang Kapulungan ang mga Pilipino at titiyaking responsableng mailalaan ang pondo at magagastos nang tama.

Dagdag pa ni Romualdez, walang sinuman ang pinapaboran ng Kamara kaya hindi sila magpapadala sa panggigipit o espesyal na interes at sa halip ay mananatiling mapagmatyag sa pagtataguyod ng prinsipyo ng good governance at fiscal responsibility.

BARBERS TO DEFIANT “FUGITIVE FROM JUSTICE” ROQUE: YOU CAN RUN BUT YOU CANNOT HIDE

Defiant “fugitive from justice” former Presidential Spokesman Harry Roque appears to be acting weird and strange by mocking the Lower House’s Quad Committee instead of justifying the sudden but unexplained increase of his wealth – from P125,000 in 2016 to P125,000,000 in 2018 – which were believed to have possibly come from POGO operations. 


Cited in contempt twice and issued an arrest order by the Quadcom, Roque had stated in a recent social media post that once he is arrested, he would challenge the latter’s decision by filing a petition for habeas corpus and certiorari before the Supreme Court. 


Surigao del Norte Rep. Robert Ace Barbers, designated lead chair of Quadcom and chair of the House Committee on Dangerous Drugs, said that while Mr. Roque is free to seek and avail of all legal remedies available to him, he needs to get arrested first before he can file those petitions before the High Court. 


Designated Lead Chair Barbers said that as far as Mr. Roque is concerned, he is considered a fugitive from justice by defying the Quadcom’s order to place him under detention. 


Barbers added that the QuadCom welcomes whatever legal challenge he may opt to against it, but he needs to get arrested first before he can file those petitions before the Supreme Court.

Barbers said that if Mr. Roque has nothing to hide on his possible links to POGOs, based on results of the ongoing Quadcom probe, he would not have to resort to disrespecting the panel, branding it as a “kangaroo court” and portray defiance with authorities by mouthing future legal challenge against it.


“Mr. Roque can run but he cannot hide from the law. Once arrested and files his petitions or legal remedy before the Supreme Court, the Quadcom will respect and abide with whatever decision the high court would dish out,” he said. 


Barbers explained the fugitive definition in the U.S. legal system “is any person who is hiding from law enforcement officials to avoid arrest. The fugitive meaning in most jurisdictions can mean someone who has an arrest warrant that is evading law and avoiding punishment. This is where the fugitive from justice phrase comes from.” 


Habeas corpus is a legal action or writ by means of which detainees can seek relief from unlawful imprisonment. “This means Mr. Roque can only file such petition once he is arrested and detained,” he said.


A petition for certiorari and prohibition, on the other hand, is an appropriate remedy to raise constitutional issues and to review and/or prohibit or nullify the acts of legislative and executive officials. “Mr. Roque has twice attended Quadcom’s hearings on POGOs and he was twice cited for contempt for lying and for refusal to submit vital documents (which he promised to comply with) that would prove he has no illegal activities or interests tied to POGOs,” Barbers explained. 


The solon from Mindanao earlier said Roque should be man enough to stand by his promise, that he would comply and submit the documents requested of him by the panel, instead of criticizing and dishing out his frustrations and posting them in the various social media platforms. 


Roque was implicated in the POGO controversy for reportedly accompanying and helping Cassandra Li Ong, an official of the Whirlwind and the illegal Lucky South 99 gaming firm, to pay off PAGCOR arrears totaling US$500,000. He has admitted, on record, to being a lawyer for Whirlwind, the company that is leasing its Porac compound to Lucky South 99.


Quadcom panel member Batangas Rep. Gerville Luistro said that as they investigate, the panel found out the sudden increase of Roque’s assets, coming from P125,000 before 2016 and has risen to P125 million in 2018. Roque served as presidential spokesperson in those period. 

“If he (Roque) will not be able to prove the legal and valid source of this sudden increase of assets of his family-owned Biancham, then there is reasonable ground to believe that indeed he is connected with POGO operations, and this money possibly came from POGO operations,” said Luistro.

The House leadership created the Quadcom, the first of its kind in the chamber’s history, to unite four House panels – Dangerous Drugs panel led by Barbers, Human Rights led by Manila 6th District Rep. Benny Abante, Public Order and Safety chaired by Abang Lingkod Rep. Joseph Stephen Paduano and Public Accounts chaired by Santa Rosa City Rep. Dan Fernandez– because they are separately conducting investigations on POGOs, EJKs and illegal drugs with same resource persons and with similar or interrelated subjects. (30)

Majo VP may be liable for graft if she can’t justify intel, DepEd expenses


VICE President Sara Duterte may be liable for graft if she cannot justify P73.2 million in intelligence expenses disallowed by the Commission on Audit (COA), and supposed P12.3 billion in similar “disallowances and suspensions” in the Department of Education (DepEd) in 2023.


This is according to House Majority Leader Manuel Jose “Mannix” M. Dalipe who urged the COA to make a final report soon on the questionable disbursements, together with its recommendations.


“More than just allegations of mismanagement, she may be held liable for graft, for possible violation of the anti-graft laws, if she cannot adequately explain and justify the adverse findings, and if the COA does not accept her explanations and justifications,” Dalipe said.


As it is, he said the COA has been asking VP Duterte tor return the P73.2 million disallowed from her spending of P125 million in intelligence funds that were used up in just 11 days, or P11.36 million a day, he said.


Dalipe said the audit commission has been similarly requiring her, as education secretary, and other DepEd officials to allegedly repay the government of P12.3 billion in expenses that were of doubtful legality and validity.


The Vice President served as DepEd secretary at the start of the Marcos administration until she resigned last July 19.


In its audit of the P125-million intelligence fund of the Office of the Vice President, the COA noted several irregularities, including late submission of liquidation reports, irregularities in notarization dates and the failure to submit required accomplishment reports to pertinent offices in a timely manner. 


The House leader said the most glaring concern is the unexplained disallowance, which amounts to more than half of the confidential funds used by the OVP in 2022.


"This raises serious questions about the propriety of how these funds were used. The fact that ₱73 million was flagged means that the public deserves answers. If the Vice President's office cannot explain or rectify these discrepancies, this could lead to more than just administrative penalties. It could point to criminal liability for graft," he said.


COA’s audit further revealed that the 2023 confidential fund liquidations are still under scrutiny, with two Audit Observation Memorandums (AOMs) issued covering the first three quarters. 


Dalipe noted that while no notices of disallowance have been issued yet, the AOMs suggest significant deficiencies that must be addressed to avoid potential disallowances in the future.


The congressman called on relevant agencies, notably COA and Congress, which has oversight power over public funds, to take the audit findings on OVP intelligence funds and DepEd expenses seriously.


He said the audit and investigation of these disbursements should be pursued to their logical conclusion.


“No one, regardless of position, is above the law. If public funds were misused, we owe it to the Filipino people to hold those responsible accountable,” Dalipe stressed.


In calling on COA to make a concluding report accompanied by recommendations, Dalipe pointed out that in the past, the audit commission had submitted its final finding to the Office of the Ombudsman if the case of public officers unable to return suspended and disallowed expenses.


Just recently, he said a town mayor was ordered dismissed by the Ombudsman even if he paid back part of the disbursements deemed unauthorized by COA.


“So I am asking the COA to submit its final report the Office of the Ombudsman and Congress ASAP. It rules should apply to all public officers, regardless of rank,” he reiterated.


Based on its audit report on DepEd for 2023, the last full year VP Duterte headed the agency, the COA issued notices of suspension amounting covering P10.1 billion, notices of disallowance totaling P2.2 billion and notices of charges worth P7.38 million due to “noncompliance with existing laws and regulations.”


The COA said it had required “management,” meaning DepEd officials led by Duterte, to returned the funds and that they had agreed to do so. 


“We recommended, and the management agreed, to cause the immediate settlement of the suspensions, disallowances, and charges in accordance with the revised RRSA (Rules and Regulations on Settlement of Accounts),” the COA said in its report. (END)
