RPPt Resulta ng imbestigasyon ng Kamara pwedeng gamitin sa kaso ni Duterte sa ICC

Ang magiging resulta ng imbestigasyon ng House Committee on Human Rights ay maaari umanong magamit sa kasong crime against humanity na kinakaharap ni dating Pangulong Rodrigo Duterte sa International Criminal Court (ICC).

Ito ang sinabi ni Santa Rosa City Rep. Dan Fernandez sa ginanap na pagdinig ng komite kaugnay sa extrajudicial killings (EJKs) na iniuugnay sa kontrobersyal na kampanya kontra ilegal na droga ng administrasyong Duterte.

“The outcome of this investigation can be used in filing in different courts, and can be used also as evidence in the ICC,” ani Fernandez sa pagdinig kung saan nagbigay ng testimonya si dating Sen. Leila de Lima. 

Pinalagan din ni Fernandez ang pagkwestyon ni Sen. Ronald “Bato” Dela Rosa sa kapangyarihan ng Kamara na magsagawa ng imbestigasyon kaugnay sa EJK.

“We are an independent body, and we are discussing this thoroughly. It will be dependent on the chairman what to do with the committee report. And that can be used by anybody, particularly those victims of the [war on drugs],” ayon kay Fernandez, na isang pahiwatig ng kahandaan na makipagtulungan ito sa ICC, sa kabila ng posisyon ng executive department na hindi ito makikipagtulungan sa international court.

Una ng ipinunto ni De Lima ang kakulangan ng isinasagawang imbestigasyon ng otoridad kaugnay ng mga pinaslang sa war on drugs campaign ng nakaraang administrasyon.

Sinabi pa ni De Lima na hindi hihinto ang ICC sa kanilang imbestigasyon hangga’t walang konkretong hakbang na ginagawa ang gobyerno para usigin ang mga nagkasala.

“Masyado po silang nakukulangan,” ayon sa dating senador, na tumutukoy sa imbestigasyon ng ICC.

Dismayado naman ang chairman ng komite na si Manila 6th District Rep. Bienvenido “Benny” Abante sa hindi pagdalo sa pagdinig ng mga personalidad na mayroong malaking papel sa war on drugs partikular na sina Duterte at Dela Rosa.

“We have sought to invite all those who can shed light on the different facets of this issue. Which is why it is regrettable that despite the assurances this committee has given, some key personalities have not taken the opportunity to air their side on the issue that had been raised,” ayon kay Abante.

Muli namang tiniyak ni Abante sa kanyang mga kasamahan at sa publiko ang dedikasyon ng komite sa pagiging makatarungan.

“This committee does not want to be one-sided, and to avoid this, we have endeavored to hear all sides. The integrity of this inquiry depends on obtaining all the facts and hearing all the perspectives,” giit pa ni Abante.

Sinagot din ng mambabatas ang naging pahayag ni Dela Rosa sa media na kumukwestyon sa kakayahan ng komite sa pagsasagawa ng imbestigasyon.

“I would like to answer the question of authority raised by Senator Bato dela Rosa, that this committee does not have any right to investigate. Well, let me tell the good senator, you’re a senator—we have the right according to our rules. You have been interviewed in the media, how I wish that you can be here and make it clear to us,” ayon kay Abante.

Binanggit ng mambabatas ang mga nakaraang pahayag, kabilang na ang testimonya ni Police Col. Jovie Espenido, isa sa mga prominenteng tagapagtaguyod ng kampanya ni Duterte laban sa droga, na umamin sa mga paglabag sa karapatang pantao sa kanyang panunungkulan.

Binanggit din ni Abante ang pag-amin ni Dela Rosa sa mga paglabag sa karapang pantao ng pambansang pulisya noong siya ang hepe ng Philippine National Police, at tinawag niya itong "collateral damage."

Sa puntong ito, humingi ng paglilinaw si ACT Teachers Rep. France Castro tungkol sa mga imbitasyon ng komite kay dating Pangulong Duterte.

“I made a statement that if former President Duterte will not be able to come—and he has already manifested that he is not coming—we will still write him a letter to come,” giit ni Abante.

“But I would not want to go into a show-cause order for the president, being the former president. But we are going to continue inviting him to come, including Senator Bato Dela Rosa,” dagdag pa ng mambabatas.

Binigyang-diin ni Abante ang kahalagahan na lumahok ang bawat panig sa imbestigasyon upang marinig ang kanilang panig.

“We do not want to be biased in this situation, let us reaffirm our commitment to justice and the rule of law,” saad pa ni Abante. 

Dagdag pa niya:“Our work here is proof of our commitment to uncover the truth and to exact accountability. It is evidence of our commitment to ensure that the rights and dignity of every individual are respected, of our commitment to uphold human rights.” (END)
